There is an alarming trend of increasingly using active duty military in "support" or "observation" roles to assist civilian law enforcement. In this case, it appears military police from Ft. Rucker were brought in after the gunman was dead, to assist in cordoning off the crime scene area(s) in support of the civilian police.

Our position is that the U.S. military should not be involved in any capacity in local law enforcement, not even in a supposed "support" role.

First of all, this was a local criminal matter only, not a federal matter. No part of the federal government has any jurisdiction. Thus, merely calling it "support" and not law enforcement does not cure the threshold problem of the federal government involving itself in the internal police of a state.

Under the original understanding of the Founders, the federal government would have no authority to act regarding such intrastate matters. What the American people consented to by ratifying the Constitution of 1787 was a dual sovereignty system, granting the new national government only certain, enumerated, and limited powers, with no general police power (a general law-making power to pass laws for the health, safety, and welfare of the people). Only the States had such a general power, which they retained, as the debates over ratification make clear:

The powers delegated by the proposed Constitution to the federal government, are few and defined. Those which are to remain in the State Governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation, and foreign commerce …The powers reserved to the several States will extend to all the objects, which, in the ordinary course of affairs, concern the lives, liberty, and property of the people; and the internal order, improvement and prosperity of the State. - James Madison, Federalist 45

Under that original understanding, the FBI, for example (let alone federal military police!), would have no jurisdiction or grounds for being involved in a local crime. Unfortunately, that concept of a federal government limited to few and defined powers, exercised principally on external objects, such as war, has been flipped on its head (through artful court decisions "interpreting" the commerce clause), such that we now have over us a federal government that claims all powers not expressly and specifically forbidden, and the power to make laws over us in all cases whatsoever.

Secondly, calling such involvement "support" is a very thin fig leaf to cover what is clearly a use of the military in a law enforcement capacity, in violation of Posse Comitatus. The military police were used to man blockades.

If the civilian police need additional help, they should look first to the militia of their own state, such as the select militia now known as the Alabama National Guard, under the command of that state's governor.

This increased use of the military in domestic roles is especially alarming in light of the permanent assignment of the 3rd Infantry Division's 1st Brigade Combat Team to a domestic "support" role, under command of U.S. Army North (NORTHCOM). That brigade combat team includes heavy armor, artilery, and mechanized infantry elements.

On October 1, 2008, the US Army announced that the 3rd Infantry Division’s 1st Brigade Combat Team (BCT) will be under the day-to-day control of U.S. Army North, the Army service component of Northern Command (NORTHCOM), as an on-call federal response force for natural or man-made emergencies and disasters, including terrorist attacks.

This marks the first time an active U.S. Army unit will be given a dedicated assignment to NORTHCOM, where it is stated they may be "called upon to help with civil unrest and crowd control or to deal with potentially horrific scenarios such as massive poisoning and chaos in response to a chemical, biological, radiological, nuclear or high-yield explosive (CBRNE) attack." These soldiers will also learn how to use non-lethal weapons designed to "subdue unruly or dangerous individuals" without killing them, and also includes equipment to stand up a hasty road block; spike strips for slowing, stopping or controlling traffic; shields and batons; and beanbag bullets.[5] However, the "non-lethal crowd control package [...] is intended for use on deployments to the war zone, not in the U.S. [...]".[5]

The US military will have around 20,000 uniformed personnel in this role in the United States by 2011, specifically trained and equipped to assist state and local government, respond to major disasters, terrorist attack, other major public emergencies.[6] This shift in strategy is a result of recommendations by Congress and outside experts.[6] This response capability is not new, but now accompanies a permanent assignment of forces to NORTHCOM.


All of the above is the proper responsibility of the National Guard, under the command of a state's governor, not the regular Army.

Our constitutional republic is being transformed into something entirely incompatible with the principles upon which this nation was founded.

More About Moms and Women

My Mother is quite a gal who carries herself with dignity and has many wonderful experiences to share. Mom is a wonderful type of woman that the scriptures tells us about and places the highest values on such a woman. I mentioned Cherie Call and LaRene Call last week as 2 such women. I can name a lot of powerfully good influences in my and many others lives. Karen Potts, as well as all her sisters are absolutely the best group of sisters I have known. Stephanie Abney has endured more than most 3 people and has a great and giving spirit that will surely bless her posterity forever. Roberta Stapley has been a joy to know and share with. My 2 daughters, Rebekah and Megan are following in the mold of these great women and make me happy.

Mom once played triple A Softball in Southern California semi pro league play. I learned a bit about base ball and sports because of Mom. In the 1990's she took physical therapy treatments with Wally Moon. My sports obsessions came from her. It could be I got my feisty sense of right and wrong from her also.

She stood up to a Communist Party man in the mid 1960's in Portland Oregon at the Rink-Side Cafe where she Managed. This bully had her place of work put on surveillance to intimidate her. She did not change for this communist thug and his Reed College look-outs. Two years later the same man entered her boss' office at Sears in the Watts area of Los Angeles to complain of the bad woman they had working there. Mom's reputation was such that the man was considered a liar at once.

Mom is nearing 79 years old and has recently lost another lifetime friend to Cancer while just being diagnosed with cancer herself. Now Mom likes to listen to talk radio, writing emails to several of her favorites and is read on several programs. Following is an email she sent to David Stein with Sporting News. David calls Mom his resident WordSmith. David is not a negative story kind of guy but loves to report the positive. He opens each call asking the caller what is going good in your Life? From his page at Sporting News is this quote:

How Much Worse is it Going to Get?

I love what I have heard of David Barton and Wall Builders. Deacon, I cannot separate out morality and religion from politics or finance, as it is morality that has collapsed our financial systems and allows politicians to be a major part of that collapse.Government allowed the greed to go unchecked on wall street and even fed the problem with rules to force loans to people who could not pay. Government said AIG could cover all faults and now we are bailing them out every 6 months. When we were young, government said we needed to take God out of schools (1950's and 60's) and did so effectively and has replaced God and with Secular Humanism. Children now are taught to worship the creation and disrespect the Creator.

Please do get ready for huge inflation and then a world currency to be offered to solve problems attached to a world court and police that makes the UN look like a pacifist orgainzation and not the perpetrator of genocide all over the world it is. Just remember Croatia, Somalia, Ethiopia and other more recent and distant UN fiascos. We gave up freedom for a promise of security and as Ben Franklin said:
They who can give up essential liberty to obtain a little temporary safety, deserve neither liberty nor safety.

Let's not give up more of our Liberties!!! I am sure it will not reestablish the wealthy country our over inflated stock market pretended we were. We may need to tighten our belts, but that is part of why some of us use these beautiful bikes. And certainly do not give up prayer and religion as God was the reason for America's rise to greatness once and only He can help us rise again.

Heavenly Father warns of Mans Weakness

1) "And thus we can behold how false, and also the unsteadiness of the hearts of the children of men; yea, we can see that the Lord in his great infinite goodness doth bless and prosper those who put their trust in him.
2) Yea, and we may see at the very time when he doth prosper his people, yea, in the increase of their fields, their flocks and their herds, and in gold, and in silver, and in all manner of precious things of every kind and art; sparing their lives, and delivering them out of the hands of their enemies; softening the hearts of their enemies that they should not declare wars against them; yea, and in fine, doing all things for the welfare and happiness of his people; yea, then is the time that they do harden their hearts, and do forget the Lord their God, and do trample under their feet the Holy One—yea, and this because of their ease, and their exceedingly great prosperity.
3) And thus we see that except the Lord doth chasten his people with many afflictions, yea, except he doth visit them with death and with terror, and with famine and with all manner of pestilence, they will not remember him." Helaman 12:1-3
How many of us have been blessed with plenty and not recognized God's hand in our lives of plenty? Myself I can see a repeated pattern of getting and becoming proud of what I have, in my pride committing sins that make me sorrowful which sometimes costs me my possessions along with my happiness. This is one reason I try to not value my things too greatly. Really the nick nacks, tools, clothes and etc. I collect really only need to help me to do my work each day. I have more than enough to do most jobs I do and to enjoy life also.
More importantly I am finding that I need to be ever repentant of errors and diligent in my commitment to the gospel ways. I am renewing my Sacrament Vows daily and reporting daily to Heavenly Father, both reports through prayer. I am finding more happiness and less straying away from the ways I know keep me close to the Holy Ghost. This may not include me into the group that make the Celestial Kingdom, but if I neglect these safeguards against my weaknesses, I will not be there ever and may attain damnation instead. Paraphrasing Joshua of the Old Testament, As for me and my house I chose to follow the Lord.
"23) Therefore, blessed are they who will repent and hearken unto the voice of the Lord their God; for these are they that shall be saved.
24) And may God grant, in his great fulness, that men might be brought unto repentance and good works, that they might be restored unto grace for grace, according to their works.
25) And I would that all men might be saved. But we read that in the great and last day there are some who shall be cast out, yea, who shall be cast off from the presence of the Lord;
26) yea, who shall be consigned to a state of endless misery, fulfilling the words which say: They that have done good shall have everlasting life; and they that have done evil shall have everlasting damnation. And thus it is. Amen." Helaman 12:23-26

Cherie Call & her Mom

I know Cherie's Mom about whom these words were written. Two of my favorite people from the time I spent at Heritage Academy were LaRene and Cherie Call. LaRene taught math to students, and we loved to share insights and she shared every CD Cherie recorded in the 7 years I worked with her. I remember Joe and Cherie's wedding day and the reception at her mom's house. Cherie is now a mom and will fill these same sacred roles she wrote about her mother in this song. I highly recommend any of Cherie Call's music, available at iTunes!, Deseret Books, and her website. Cherie's music is always close to my emotions when I listen to it.
she has won awards for her writing and I love to listen to her sing and play these songs.
